Terms of Service
The general terms governing the use of the Roomlytics service.
1. The Service Provider
MORGENS Design Marketing Tanácsadó és Informatikai Szolgáltató Kft. (MORGENS Design Kft.) — registered office: 8800 Nagykanizsa, Magyar utca 79., Hungary; company reg. no.: 20-09-072782 (Registry Court of the Zalaegerszeg Regional Court); tax no.: 23964710-2-20; email: hello@roomlytics.ai; phone: +36 70 642 0833 — hereinafter the "Provider".
2. Scope and acceptance
These Terms of Service ("Terms") apply to the roomlytics.ai website and the Roomlytics service. By ordering or starting to use the service, the ordering hotel or business (the "Customer") accepts these Terms. The provisions of an individual agreement prevail over these Terms.
3. The service
Roomlytics is a direct-booking business intelligence (BI) platform for hotels: it collects and analyses data from the Customer's marketing and sales channels (including Google Ads, Google Analytics 4, Meta, booking engine and email platforms) on a single reporting interface, with AI-written summaries and shareable report links. The Provider continuously develops the platform; the set of available features may expand and change.
4. Contracting, fees, payment
The service is available on the basis of an individual quote and agreement; fees, invoicing and payment terms are set out in the individual quote. Unless agreed otherwise, invoices are payable by bank transfer by the due date indicated on the invoice.
5. Customer obligations
The Customer provides the account access required for the service (e.g. Google Ads, Google Analytics, Meta, booking engine) and warrants that it is entitled to grant such access. The Customer keeps its credentials and report links confidential and does not use the service unlawfully.
6. Third-party services
The platform connects to services of third parties (in particular Google and Meta); those services are governed by the third parties' own terms and policies, and the Provider is not responsible for their availability or changes. Roomlytics' use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements — see the Privacy policy for details.
7. Availability
The Provider strives for continuous availability; temporary unavailability due to planned maintenance or outages of source systems (e.g. advertising platform APIs) does not constitute a breach. Data freshness in reports depends on the data supplied by the source systems.
8. Intellectual property
The Roomlytics platform, its software, interface and methodology are the Provider's intellectual property. For the duration of the contract the Customer receives a non-exclusive, non-transferable right to use the service; the Customer remains in control of its own business data.
9. Liability
Reports and analyses provide decision support; the Customer is responsible for its business decisions and their consequences. Except for liability for intentional breach or for damage to life, limb or health, the Provider's liability is limited to the service fees paid by the Customer in the 12 months preceding the damage; the Provider is not liable for indirect or consequential damages or lost profits.
10. Data processing
The processing of personal data — including Google user data — is governed by the Privacy policy.
11. Confidentiality
The parties keep business secrets and confidential information obtained in the course of performance confidential, also after termination of the contract.
12. Termination
The contract terminates as set out in the individual agreement. Upon termination the Provider closes the Customer's access and deletes the data obtained from channel integrations within 30 days.
13. Governing law, disputes
These Terms are governed by Hungarian law. The parties will first seek to settle disputes amicably; failing that, the competent Hungarian courts have jurisdiction.
14. Final provisions
The Provider may amend these Terms; amendments take effect upon publication on this page and apply to services ordered after publication.
Effective from 5 October 2026.
